Purposes and legal bases for the processing of personal data

The purpose of the processing is to fulfill the public tasks assigned to us by law, in particular to inform the public.

Die Rechtsgrundlage für die Verarbeitung Ihrer Daten ergibt sich, soweit nichts anderes angegeben ist, aus Art. 4 Abs. 1 des Bayerischen Datenschutzgesetzes (BayDSG) in Verbindung mit Art. 6 Abs. 1 UAbs. 1 Buchst. e der Datenschutzgrundverordnung (DSGVO). Demnach ist es uns erlaubt, die zur Erfüllung einer uns obliegenden Aufgabe erforderlichen Daten zu verarbeiten.

Recipients of personal data

In order to prevent threats to information technology security, data may be forwarded to the State Office for Information Technology Security in the event of electronic transmission and processed there on the basis of Art. 12 et seq. of the Bavarian E-Government Act.

Duration of storage of personal data

Your data will only be stored for as long as is necessary for the fulfillment of tasks, taking into account statutory retention periods.

Further treatment of this data

e.g. For reasons of technical security, in particular to defend against attempted attacks on our web server, this data is stored by us. After seven days at the latest, the data is anonymized by shortening the IP address at domain level, so that it is no longer possible to establish a reference to individual users.

  • Citizen Service Portal

AKDB

The citizen service portal offers online administrative services and is operated on our behalf by the AKDB (Anstalt für Kommunale Datenverarbeitung in Bayern). When applying for an administrative service, you are required to enter your personal data, such as your surname and first name. Only the data required for processing is collected. Please refer to the relevant information sheet (Information on the collection of personal data (Art. 13 GDPR)). Your personal data will not be used for any other purpose and will only be passed on if the requested service requires it or if we are legally obliged to do so. The storage periods are determined on the basis of the service requested and provided.

  • Citizen information system, council information system

BIS from Living Data

In our citizen information system, you will find information on the meetings and the items on the agenda, current meeting dates and an overview of the composition of the committees. The system is operated on our behalf by Living Data. The personal data of committee members is processed with their consent. Personal data is only provided in the agenda items, minutes and records to the extent necessary for the fulfillment of tasks. You use the "Calendar of meetings" and "Reminder" services voluntarily - if the system processes personal data (e.g. for an e-mail notification), this is done at your request and with your consent. Your personal data will be deleted when you cancel the services.

As part of our press and public relations work, photos are taken at events and appointments in which you may be recognizable. We regularly obtain your consent for this at our events. If you send us inquiries via the contact form or by e-mail, your details, including the contact data you provide, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions.

Your data will be deleted when it is no longer required for the fulfillment of the task. Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

  • Applications, generally on job advertisements, initiative

You send us your personal data with your application. We process this data to carry out the application process. This includes the forwarding of the application via all application channels up to the decision on the establishment of an employment relationship or a civil servant relationship. The legal basis for processing is Art. 6 para. 1 letters b) and c), Art. 9 para. 2 letters b), g), h) and i), Art. 88 para. 1 GDPR, the BayDSG, the BayBG, as well as other relevant laws (AGG, ArbGG, BetrVG, BBiG, IfSG).

In order to safeguard co-determination rights, your data may be passed on to the Staff Council, the Equal Opportunities Officer and the Disability Officer.

Your data will be stored for the duration of the application process and in accordance with the legitimate retention periods of 6 months after completion of the application process.
